Make no mistake, whether you want to recognize it or not, “reinterpreting the 14th Amendment” WOULD BE CHANGING our Constitution. In fact, regardless of whatever historical context you want to list in your arguments, there is NO room for “reinterpretation”, as the Constitution is very clear on this:
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.†-14th Amendment to the Constitution.Â
Since all people on U.S. soil are subject to U.S. laws and thus under the jurisdiction of the United States, in order to “re-interpret the 14th Amendment”, right-wingers would HAVE to change it first. So how is that not tampering with our Constitution?
